Ciaotou District Prosecutors Office Prosecutes National Security Case Involving Bribery of Military Personnel by Overseas Forces Under the Citizen Judges Act .

Chief Prosecutor Chen Chu-Chun and Prosecutor Chou Wei-Chih of this Office directed a joint task force comprising the Kaohsiung Field Office of the Ministry of Justice Investigation Bureau, the Criminal Investigation Corps of the Kaohsiung City Police Department, and the Military Security Command of the Ministry of National Defense to investigate a case involving infiltration of Taiwan’s military personnel by hostile overseas forces through online means. The suspects are alleged to have violated the National Security Act, the Anti-Corruption Act, and provisions of the Criminal Code concerning the disclosure of classified information.

Upon completion of the investigation, the Office has indicted defendant Chen ○-Cheng and nine current and former military personnel, totaling ten individuals. This case marks the first prosecution under the Citizen Judges Act involving offenses under the National Security Act.

1. Summary of Criminal Facts

Defendant Chen ○-Cheng became acquainted with members of a hostile overseas group via the internet in September 2024. After being offered complimentary travel to Macau and Zhuhai, Chen provided the group with access credentials to his online banking account and received monthly payments in return. The account was used as a financial conduit for bribing Taiwanese military personnel.

The group subsequently contacted military personnel in Taiwan via online platforms, offering monetary rewards in exchange for recording pro-unification videos and supplying classified military information. The group successfully recruited nine individuals—Huang ○-Chih, Wang ○-Hao, Chen ○-Hua, Yang ○-Hsiang, Kuo ○-Lang, Teng ○-Hao, Chang ○-Chieh, Lin ○-Yi, and Tseng ○-Chen—who were serving in or had previously served in the Army, Navy, Air Force, and Coast Guard Administration.

In exchange for payments, these individuals collected internal military information, including operational details, equipment data, and classified official documents and electromagnetic records. They photographed such materials using mobile phones and transmitted them to members of the overseas group via messaging applications.

2. Applicable Charges

Defendant Chen ○-Cheng is charged with aiding the offense of offering bribes for acts in violation of official duties under the Anti-Corruption Act, as well as providing financial accounts in violation of the Money Laundering Control Act. His conduct constitutes a single act involving multiple offenses and shall be punished in accordance with the most serious charge.

The remaining nine defendants are charged with accepting bribes for acts in violation of official duties under the Anti-Corruption Act, transmitting classified official electromagnetic records to the Mainland Area in violation of the National Security Act, and unlawful disclosure of classified information under the Criminal Code. Their offenses shall likewise be adjudicated based on the most severe applicable charge.

3、 Sentencing Recommendation

Most of the defendants are current or former military personnel entrusted with safeguarding national defense. Instead of fulfilling their duty of loyalty, they acted out of personal gain and repeatedly provided classified information to hostile overseas forces over an extended period. Their actions have seriously jeopardized national security. Accordingly, this Office recommends the court impose severe penalties to ensure deterrence.

This Office emphasizes that infiltration by hostile overseas forces through online channels and financial inducements targeting Taiwan’s military personnel has become increasingly prevalent, posing a significant threat to national security. The Office will continue to strengthen its investigative capabilities and work closely with relevant agencies to rigorously investigate such cases, thereby safeguarding national security and social stability.
